The forum was created by parents who have children with special needs and is run by parents so we are all in this together. With us you will realise you are not alone

Tax credits - overpayment and disability backdating

Hello again Smile

Just wanted some advice before speaking to the tax credits people. I'll try and be concise!

We have been awarded backdated DLA to september 2009
We received the backdated Tax Credit disability element to June 2010
We have been trying to sort out tax credit backdating to september 2009

The complication is that we had overpayments made between April and June 2010. We have already made arrangements to pay that off and these started 2 weeks ago.

Today we were sent a letter which shows that they are taking all of the backdated tax credits and putting that towards the overpayment.

Can they do this?

Forgot to add that we are a low-income family so in theory shouldn't the most they can take be 10%?

Anyway, spoke to about 6 different people today in different departments. No one seemed to have any clue, but eventually I was told it was tough. So they are sending an appeal form.

My arguments are as follows

1) The overpayment and the disability backdating are two separate issues
2) Before we got the backdating, we had already made an agreed arrangement to repay the overpayment
3) As a low income family, they could only take 10% anyway

Any thoughts?
