statement confusion???????

hi, i was wondering if any one would be able to help me, i started the statement process 2 years ago but during that time i moved and it has taken 15 months for my new lea to accept my ds proposed statement and today i have finaly recieved the finalised version. when choosing a school i looked at one for mld but was told by the head master there that he dont think my son is severe enough to be there so i named a mainstream school that he already attends but just reading his statement and it names the school he is at as the placement but also put "to attend a mainstream school whilst a suitable special school is sought" so i am a bit confused as to why they have put that, Also he has been given a band E statement 20 hours of learning support assistance, does that mean 20 hours of 1-1 plus the 5 hours the school gives him would be 25 hours 1-1, as the school are saying he wont get 1-1 just working in smaller groups. I thought they employed someone else with the extra funding just for my son am i wrong?????? |

if you want 1-1 and can prove that is what your son needs, the statement needs to say 1-1. From what you have written 20 hours of learning support assistance the school are right he will only get small group assistance. Your statement needs to say how small a small group is. Unfortunatly you now have your final statement and all amendments should have been done in the proposed statement. However you do have right to appeal and go to tribunal to have changes made, if your evidence is strong you may not have to go to tribunal as the LA may back down. Or you could wait for part 4 to be changed naming a new school as that will be a proposed statement where amendments can be made. Its not all bleak tribunals are fair and not as hard as you may think, so long as you have the evidence in black and white you stand a good chance of getting what your son needs.

Again to back up what Julie said normally it will state 1-to-1 learning if they are providing this.

hi,it does not say 1-1 support but on all the agencies that have been involved they have wrote that he will need a high level of 1-1 support all day every day, i feel that the school can not meet his needs and they do not have any one that can look ater him all day 1-1, he is still in nappies and the school does change him but some times i get called tochange him or he has often been left in a dirty nappy, not really sure what to do as the school he is at only tookhim on in April last year on the basis that he was to start a special school in september but he has ended up staying there, feel like he is going to be pushed out of main streem!

As legally the only reason the school can request you change him is because he has requested it and he wont allow them without struggle but its only with your agreement they can call you,if you say i cant attend they have to change him. The Disability Discrimination Act is clear that children should be protected from discrimination and so a child who has soiled should be changed and enabled to return to the classroom as soon as possible to resume learning.
