The forum was created by parents who have children with special needs and is run by parents so we are all in this together. With us you will realise you are not alone

adhd and Aspergers DLA?

Hello, Im equiring on behalf of my sister, my nephew has adhd and traits of aspergers.
Someone asked her if she had applied for dla for her son and why not? I started to think the same.
Would she be able to get any money for him? is there anyone else with a child with adhd & aspergers?
My nephew is currently statemented in a normal primary school and I have asked my sister if she would look at the other options like a special school.I feel like his school is letting him down, because he is loud and gullible he gets disaplined for things that other Children should be getting disaplined for but because he was involved they blame him without a thought.He doesnt have any friends,never gets invited to partys,he has problems expressing his emotions and often gets angry and punches things, he obsesses about harry potter and still believes that the film is real and wants to enroll in hogwarts, he needs constant supervision(if he were to lose a ball in the road he would run after it without second thought without knowing the dangers he faces) he constantly wants to do things, he is hyperactive, talks constantly,finds it hard to understand some things you tell him and you have to explain every little detail and repeat it, he goes into a depressive state sometimes and doesnt want to talk and this isnt like him(which is sad to see).He is very loving and even though he is 10 he still likes to tell everyone like myself and my sister how much he loves us and isnt afraid to show it in public, bless him.He always thinks about my son josh and would spend his money and buy josh sweets before himself :-)
my sister just got off the phone to me, she told me about when they went swimming yesturday my nephew started stripping off in the car whilst she was driving even though she told him to stop, whilst his sister and her friend were there.He constantly likes getting naked.He often starts a conversation with someone without knowing whether they are listening or not, he doesnt always look at people whilst talking.
Sometimes he wets the bed.
what help is there out there for children like my nephew? my sister is finding it difficult to cope at the moment.

Does he have a pead that sees him? I would most def apply, but get somebody who is familar with the forms to help fill it in as it how you word it too. So many get rejected because of this and I was always told you should always appeal.

Thanks for replying, yes he does have a specialist he sees, I can help her with the forms ive filled in quite a few and the first time I applied we got refused which was a joke.is there any charitys that would help him with holidays or days out? Im thinking of asking family fund x

If we were to apply what is the most it can be backdated? she has known for about 2years but didnt know she could apply, i think aspergers was diagnoised last summer.

DLA doesn't get backdated. If you request a form, they date stamp it on the date it was requested and as long as it is returned within 6 weeks then if the claim is successful they will backdate the DLA to the date you requested the form. For this reason it is better to apply on a paper form rather than online. I would also suggest getting advice from someone about completing DLA forms such as CAB, local advice centre or charity concerned with the child's condition.

It takes anything up to 4 months to process the claim as they contact paediatrician, OT, etc so assuming the claim is successful then the first payment is usually quite big as it backdated to the date the form was requested.
If she is on benefits, working part time (earning under £100 a week, I think?) or not working herself but her partner works (if she has one) then it could be worth claiming Carer's Allowance at the same time as claiming DLA. It will get turned down due to no one getting DLA but then if the DLA is awarded at middle or higher rate for care she can reapply for Carer's Allowance and this will be backdated to the start of the DLA claim.
With Tax Credits, once there is DLA awarded at any rate you need to tell them as there is an extra premium added on and if DLA is at higher rate for care then another premium on top of that. These are also backdated to the start of the DLAclaim.
Family Fund have their own definition of severe disability and she does not have to wait untill DLA is awarded to apply. You can download & print the form from their website or email them for a form to be sent out. First applications have to be made on paper forms, not online.
